Thank you so much for inviting me to capture your memories-in-the-making. Photography is an investment so I want to make sure that the expectations are clear for my role before, during and after your session. This is a contract between us for photography services. For this reason, if you have any questions or concerns please let me know before you sign this agreement.
PRE-SESSION DETAILS:
You are entitled to a pre-event consultation, by phone, email or in person prior to the session in order to finalize the details of the session, to discuss the style and format of the photo shoot and to discuss any personal requests.
LOCATION DETAILS:
The photographer will photograph in and around your home or location of choice. You are responsible for seeking permission for photography at any location you ask the photographer to shoot in. If the photographer is told to stop photographing at any time or for any reason, the photographer will not be responsible for missed images or events. Furthermore, you agree to indemnify and hold the photographer harmless against any suit, damages or actions arising from use of the location, excluding actions arising from the photographer’s own gross negligence or intentional acts.
CANCELLATIONS/RESCHEDULING:
Please make every effort to give the photographer 24 hours’ notice if you need to cancel the photography session. The photographer will work with you to reschedule the session within a reasonable time frame.
PROCESSING AND DELIVERY OF PROOFS:
Basic processing is included and comprises: white balance and exposure correction, cropping, and light retouching.
The photographer retains the right to edit and retouch images in a style and manner of the photographer’s choosing consistent with the photographer’s portfolio of work. The photographer will provide a combination of black and white and color images and will make an artistic decision to edit each image in color or black and white at the time of editing.
The photographer prefers to retain the photographer’s artistic and creative vision in editing and therefore will not provide RAW or unedited images. The photographer also does not provide client soft proofing.
The photographer will provide your gallery of images within 1 month of your photo session. The photographer will hand deliver or mail the image files (contained on an USB flash drive). The USB flash drive is your property and does not need to be returned. For house shoots, the photographer will deliver your images through a Dropbox link.
OWNERSHIP RIGHTS:
The photographer shall retain full copyright and interest in any and all film, digital files, proofs, samples, prints, or negatives created or produced.
You are granted a non-exclusive worldwide right to use the materials for your own personal use. You may make prints from the provided files. You may also share images with friends and family via social media as long as credit is given to the photographer. Photos or materials are NOT to be resold or distributed to any third parties. The photographs are not to be used for commercial purposes without first entering into a license agreement with the photographer.
LIMITATION ON DAMAGES:
In the unlikely event that the photographer is unable to perform the requirements of this agreement due to an injury, illness, family emergency or any other cause beyond the photographer’s control, the photographer will make every effort to reschedule your session within a reasonable period of time.
The photographer shall not be responsible for any adverse effects or the impact of such upon the photo files resulting from, but not limited to: weather, timing, actions of individuals present at any shooting location or photo files dependent upon the actions or presence of individuals at any shooting location, transportation issues, equipment failure, access to shooting locations or anything else not under the control of the photographer.
The photographer is not liable or responsible for the care of minors while performing services and any time children are left alone in the presence of the photographer, they remain solely the responsibility of the parents/guardians. In the event of injury, you shall not hold the photographer legally, financially or morally responsible.
In the unlikely event that digital files are lost, stolen, or destroyed for reasons beyond the photographer’s control, including but not limited to the camera, hard drive, or equipment malfunction, the photographer’s liability is limited to the return of all payments received for your session.
FEES:
Deposits and Session Fees can be made via check, Venmo or cash.
Please read this agreement carefully. It is understood that by signing this, you are contracting with the photographer for a photo session.
